Terms & Conditions

Comprehensive Terms and Conditions Governing Mobile Charcuterie Cart Operations and Services

1. Introduction

These Terms & Conditions (the “Agreement”) set forth the legally binding terms and conditions for the provision of mobile charcuterie cart services (“Services”) by Down South Christmas Hire, operating as a mobile catering provider (“Provider”, “we”, “us”, or “our”), to clients (“Client”, “you”, or “your”). By booking or utilizing our services, you agree to be bound by this Agreement.

2. Service Description

Our mobile charcuterie cart offers a curated selection of meats, cheeses, accompaniments, and related catering services. The Artisan Cart reserves the right to modify, substitute, or alter the menu or offerings at its discretion, subject to availability and operational requirements.

Services are available for private and public events, including but not limited to celebrations, corporate functions, markets, and festivals.

The Artisan Cart may be set up indoors or outdoors, subject to venue approval and compliance with local regulations.

Special dietary requirements or allergies must be communicated in writing in advance.

3. Booking and Payment Terms

Bookings are accepted on a first-come, first-served basis, subject to availability.

A non-refundable deposit, typically 25%, is required to secure your booking. The remaining balance must be paid 7 days prior to the event date.

Down South Christmas Hire accepts payment methods; Cash, Direct Deposit, Credit / Debit Card and Paypal.

Any additional charges incurred during the event (e.g., overtime, menu upgrades) must be settled within 7 days of the event completion.

4. Cancellations and Refunds

Cancellations made 8 days prior to the event will result in full refund of the deposit.

Cancellations made 1 – 7 days prior to the event will result in forfeiture of the deposit.

No refunds will be issued for cancellations due to events outside of our reasonable control, including but not limited to severe weather, venue restrictions, or force majeure.

5. Client Obligations

Clients must provide accurate event details including date, time, location, and estimated guest numbers at the time of booking.

Clients are responsible for obtaining any necessary permits or permissions for The Artisan Cart to operate at the chosen venue.

Clients must ensure the venue allows food service and has adequate space and access for The Artisan Cart and staff.

Clients must notify Provider of any allergies, dietary restrictions, or special requests at time of booking.

Clients are responsible for the conduct of their guests and any damage to The Artisan Cart equipment caused by guests or third parties at the event.

6. Provider Obligations

The Artisan Cart will supply the agreed-upon menu or reasonable substitutions if required due to supply constraints.

Provider staff will arrive promptly and operate professionally throughout the event.

The Artisan Cart will comply with all relevant food safety, hygiene, and local licensing regulations.

All serving ware, utensils, and display items needed for The Artisan Cart will be provided.

7. Health, Safety, and Allergens

The Artisan Cart makes every effort to accommodate dietary needs and allergen requests but cannot guarantee the absence of allergens due to shared facilities and suppliers.

Clients and guests with severe allergies are advised to exercise caution and communicate specific needs clearly.

Provider maintains current health and safety certifications and ensures compliance with all applicable laws.

8. Limitation of Liability

To the maximum extent permitted by law, The Artisan Cart shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to the provision of services.

The Artisan Cart’s liability for any claim shall be limited to the total amount paid by the Client for the event in question.

The Artisan Cart shall not be liable for damages resulting from Client’s failure to disclose relevant information or obtain required permissions.

9. Force Majeure

The Artisan Cart shall not be responsible for any failure to perform its obligations under this Agreement if such failure results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, labour disputes, government orders, pandemics, or other unforeseen events. In such cases, The Artisan Cart will work with the Client to reschedule or reasonably accommodate the service.

10. Photography and Promotion

Provider may take photographs or video footage of The Artisan Cart and setup during your event for promotional purposes, unless otherwise agreed in writing prior to the event.

Clients may request in writing that no images be used in promotional materials.

11. Intellectual Property

All trademarks, branding, menu names, and other intellectual property associated with The Artisan Cart remain the exclusive property of The Artisan Cart and may not be used or reproduced without permission.

12. Privacy

Personal information collected for bookings will be handled in accordance with applicable privacy laws and will not be shared with third parties except as required for the fulfilment of services.

Clients may request access to, or deletion of, their personal information at any time.

13. Dispute Resolution

Any disputes arising from this Agreement shall first be attempted to be resolved amicably between the parties. If a resolution cannot be reached, disputes will be subject to the jurisdiction of the courts of Western Australia.

14. Amendments

The Artisan Cart reserves the right to amend these Terms & Conditions at any time. Updated terms will be posted on our website and, where possible, communicated to existing clients. Continued use of The Artisan Cart’s services after such amendments constitutes acceptance of the new terms.

15. Acceptance

By booking and/or utilising our mobile charcuterie cart services, the Client acknowledges they have read, understood, and accepted these Terms & Conditions.
